(Selling Agreement)

 
1. SellMyOldCellPhone buys cell phones and PDA’s, GPS equipment, and MP3 players.
2. SellMyOldCellPhone.com provides the service of evaluating your electronic equipment and buying it if it meets certain conditions.  The amount offered for any electronic device in this website is identified as a Pre-Inspection Offer and is what will be paid if the device meets the conditions listed below.  It is the desire of SellMyOldCellPhone.com to buy and pay top dollar for every cell phone and other electronic equipment submitted in a Pre-Inspection invoice.  In order for us to pay top dollar, each cell phone and other electronic equipment must be fully functional and "like new" in appearance in order to be paid the maximum amount offered.  We will, however, pay for phones or other electronic equipment that do not meet the like new condition, but at a reduced amount (describe further below).  Please keep in mind that it is industry standard to pay less for phones and other electronic equipment that may be something less than perfect, or "like new". So anyone you sell to, you should read their Terms.
3. It is important to note that the Pre-Inspection Offer is tentative until your phone(s) or other electronic equipment have been received, completely inspected and any Post Inspection Offers initiated. The Pre-Inspection Offer is replaced by the Post Inspection Offer, which is sent to you via email, and is then available for acceptance or rejection (either by responding with YES in less than 2 days or by default).  (Please note:  You MUST make sure that SellMyOldCellPhone.com is on your "safe" list for your email system/carrier.  We will not be responsible for emails from us that do not make it to your inbox.  This is your responsibility.) Read furthe below regarding acceptance or rejection of Post Inspection Offers. 
4.  "Like new" and fully functional, for SellMyOldCellPhone.com means (Keep in mind that some of the following conditions may not apply to other electronic equipment):
   a. It must power and the battery be able to receive and hold a charge.
   b. It must make and receive a test call.
   c. LCD display(s) must fully work and not be broken, bleeding or cracked or damaged in    any fashion.
   d. All members of the keypad/keyboard must work and all scroll bars and roller bars must work. All removable parts (like battery doors) must be included.
   e. The antenna (if applicable) is intact and fully functional and the body of the phone where the antenna meets is not cracked or separated.
   f. No loose or broken flips, slide, or swivel and the display light comes on as designed.
   g. Ringer works, speaker and microphone work, camera works and all web browsing functions, including PDA and GPS functions work as designed.
   h. All features of that particular model must work, IE. Texting, touch screen, email, push-to-talk, MP3, games, GPS, satellite connection etc.
   i. No red dots! (Check inside the phone behind the battery.  If you see a red dot you should know that this phone will be considered broken, even if it works. A red dot means contact with moisture and voids even the manufacturer warranty. Also look at the battery which in some cases will have a similar color changing mechanism used to indicate water contact.) Do not remove the red dot. A phone that is missing it’s moisture indicator will not be purchased either.
   j. It should be "released" from your service provider (if you do not use a SIM card), i.e. Verizon, Sprint, etc. and not have an account balance, reported lost or stolen. In other words, it must be able to be reactivated, without exception.
   k. It should not be stolen or found. If a phone is reported stolen by it's service provider, you will not have the option off getting it back nor will you be paid for it. 
   l. It should have as little signs of use as possible.  A small nick or a hairline scratch will not disqualify it from being "like new" in appearance and receiving the full amount offered, but that small nick and/or hairline crack is to be left to the discretion of the Processing Department Manager at SellMyOldCellPhone.
   f. All cell phones must have a legible ESN/IMEI tag, no exception.
(A note about water exposure; A white dot that has "bled" and turned red beneath your battery on your phone or other electronic equipment is an indication that it has come in contact with moisture. We will not buy phones with red dots and they will not be returned.)
5. Phone(s) or other electronic equipment that arrive without batteries or non-working batteries will be accepted but a battery replacement fee ($10.00 for non PDA phones, $20.00 for PDA phones, and $20.00 for GPS devices) will be deducted from your phone(s) or other electronic equipment purchase price. Please make sure phone(s) or other electronic equipment have their batteries and are fully charged before sending. Also, make sure a charging device is included.
6. Please do not attempt to sell a phone or other electronic equipment that is stolen or one that has been found; it will be reported to proper authorities.
7. PHONES WITH SIM CARDS DO NOT NEED TO BE RELEASED OR HAVE A ZERO BALANCE. All others MUST be released, have a zero account balance, not be reported as lost or stolen, and ultimately be capable of reactivation. If a phone cannot be reactivated, it is not elibible for return.
8. Each cell phone and other electronic equipment must have a valid, verifiable, and legible IMEI, ESN, or other Serial Number. That means we will not accept a phone or other electronic equipment that is missing the serial number sticker inside or is scratched off of blotted out and will not be eligible for return.
9. It is the SELLER'S (you) responsibility to remove all pictures, phone numbers, and other data from each cell phone or other electronic equipment being sold.
10. Like we said earlier, if your phone or other electronic device is less than "LIKE NEW", we will still take it but the amount paid will be scaled down based on cosmetics. We will contact you via e-mail, after your phone or other electronic equipment has been inspected, with the Post Inspection offer (if necessary) based on a four star rating system. We use a four star system of rating as describe below:
  a. Five stars pay 110% that means: NEW. Never Used w/ no signs of use.                
   b. Four stars pay 100% that means: EXCELLENT. Used, no signs of use, mint.            
   c. Three stars pay 75% and means: GOOD. Have some very light signs use.           
   d. Two stars pay 50% and means: FAIR. Heavy signs of use.                                   
   e. One star pay 25% and means:  POOR. Extremely heavy signs of use.                
   f. Zero stars pay 10% and means that it is broke, as listed above, in some way (Please note:  
You ONLY get the 10% IF the phone you are selling is listed as broken) 
11. Please keep in mind, you can send a broken phone or a phone with a bad ESN (can't be reactivated), but please list it as "broken" so we can pay you the 10%. If it is listed as "good" (meaning it meets the criteria listed above) when in actuality it is broken in some way (meaning it does not meet the criteria listed above) it will not be paid on and is not eligible for return.  If you send a phone or other electronic equipment that is reported lost or stolen, has a balance, or has a red dot, broken or any reason listed here in these Terms and Conditions (Selling Agreement) and it is marked as "good", it will not be paid on at all and will become the property of sellmyoldcellphone.com.  The only returns available are those that originate from Post Inspection Offers relating to the cosmetic condition of the device(s) in question. If they are rated 4 stars or 0 stars (broken, red dot, balance, stolen, etc), they are not eligable for return and will be paid on.
12. When listing models, you must use the actual model number written inside the phone or other electronic equipment. Do not judge the model by picture alone as many models are nearly identical.  Incorrect models will be paid the corrected model amount due based on cosmetic and functionality rating.
13. SellMyOldCellPhone will send you an e-label from the United States Postal System (USPS) for your to ship your device to us for free.  You will receive an email with an attachment from the USPS. You need to have Adobe Acrobat in order to open the attachment and print. If you do not have Adobe, you can download for free from Google by doing a search for Adobe.  EXCESSIVE POSTAGE CLAUSE: Although shipping is free, be mindful of your packaging.  On average it costs about $5.00 for one phone, $6.00 for two phones, $7.00 for three phones. More than three phones simply depends on overall weight.  Excessive postage is defined as costing more to send than the company average.  For example, using a flat rate Postal Box to send one phone is excessive.  Excessive postage will be determined by the manager on duty at time of reception.  Excessive postage will be deducted from your final total. 
14. When you ship your phone(s) or other electronic equipment, make sure they are packed well and secured so that upon arrival they will not be crushed or otherwise damaged from shipping. We do not accept the following liabilities associated with shipping:
a. Damaged while enroute, or
b. Lost or stolen while enroute
15. If you are sending high dollar phones or other electronic equipment, we recommend that you consider shipping insurance.  If the USPS charges our account for insurance (or any other "extra" charges not related directly to the transit of the device(s)), it will be deducted from the total to be paid.  We will provide you with a FREE USPS shipping label emailed to your computer, but you would need to secure insurance and pay for it if you choose.
16. When you ship your item, the best method of shipping is actually a bubble or padded envelope.  They already provide cushion and tend to be more rugged than a standard envelope.  A small box is fine also.  Please do not use a flat rate box from the USPS. The excess shipping charges will be deducted from your total. The method used to determine "excess" is based on the actual weight of the items sent from your location to our location determined by the USPS shipping rates.
17. All communication is transacted via emails. Please allow one working day to respond. Generally, emails are answered much quicker than that.  Hours of operation are 9am to 6pm Monday – Friday.
18. IT IS THE SELLER'S RESPONSIBILITY TO REMOVE US AND THE USPS FROM YOUR SPAM BLOCKER. ALL CORRESPONDENCE IS CONDUCTED VIA EMAILS.
19. As part of the communication process, it is the seller's responsibility to maintain their personal information in their account. If you move or change your phone number, please update your account accordingly. Any returns and/or checks mailed to an incorrect address will not be the responsibility of SellMyOldCellPhone, and as such, SellMyOldCellPhone will not assume or be assigned the liability of the return or check that was sent to an unmodified addressed. If a request is made to have another check sent to a modified address, a stop payment fee of $30.00 will be applied to your payout and deducted from the new check written and mailed to you.
20. We DO NOT purchase the following Service Provider Cell Phones: NECC Wireless, Embarq, TelCel, Rogers Wireless, Simply Freedom,  STI Mobile, DISNEY MOBILE, EARTHLINK WIRELESS, AMP'd Mobile, KDDI MOBILE, 3UK/Orange, Qwest, Cellular South, Alltel, OLD ATT, Virgin, Vodafone, CBeyond or TIM.  We also do not purchase any PRE-PAID SERVICE PROVIDERS including TRACFONES and any similarity thereof. We only accept the above for recycling or donation; We will not pay out on any of the above phones.
21. All prices are good for 10 days from the date the purchase invoice and e-label is produced to the day the device(s) are received by SellMyOldCellPhone.com.  Orders received outside the 10 day guarantee will reflect the updated price, if applicable, without exception.  Price changes outside the 10 day guarantee have no reconsideration (except as stated above for cosmetic purposes). Prices are highly volatile and subject to change depending on the current market value of the phone or other electronic equipment in its received cosmetic and functionality condition. It is important to utilize the e-label for shipping immediately.
22. Once you submit a Purchase Request to sell your phone(s) or other electronic equipment, we will process that order and send you a notification via email indicating that we have received your submission, reviewed it, and conditionally accepted it. It is conditional because we have not yet had an opportunity to view the product and test it. You will be sent a USPS shipping label to your computer from the USPS website. You need to make sure you add the USPS to your safe list in order to receive it in your in box.  If you do not receive it within 6 hours, check your spam email box and then notify us and we will be glad to have it sent again.
23. Once we receive your device, we will send you an email indicating that your device has arrived and is being placed in queue for processing. The processing of your device can take several weeks depending on the number of other devices ahead of yours.
24. We request about 7 days to process your phone(s) or other electronic equipment. You may receive an email notification of your Post Inspection Offer, if applicable, approximately 3-4 days after receiving devices. Approximately 3 or 4 days after that, you will receive a payment notification that your payment is being processed then followed by a payment via US first class mail from our bank. Please allow 10 days for delivery. These times are approximate. You may also be sent emails requesting additional information and assistance. If your phones have issues that require your attention, payment will be delayed until the problem is cleared up; please respond as quickly as possible to minimize delay. Payment is made through Bank of America in the form of a corporate check and has a delivery time of up to 10 days.  The 7 day payout only applies to all new orders placed after May 5th, 2010.  Be advised that orders over 0ne thousand dollars may take longer to receive payout, as much as 14 days.
25. No matter how many phones or other electronic equipment you submit, we treat each phone and other electronic equipment in your invoice as though it has its own selling agreement. Therefore, if you send more than one piece of equipment and one of them is in less than "like new" condition, all the others will proceed as originally designated and the processing of the reduced phone(s) or other electronic equipment will stop. We will submit an email to you (make sure we are on your email's "safe list") indicating the reason for its reduction along with either of the following:
   a. No offer to buy or
   b. A reduced offer to buy based on its resale value in its current cosmetic condition.
26.  You will have the opportunity to review our Post Inspection Offer and accept or reject it. If you accept, your order will continue processing and payment will be made. If you reject it, you may get the phone or other electronic equipment back if you wish, but you will be responsible for return shipping (which includes original postage and labor involved in processing your device). The return fee is a flat $15.00 (for 1-2 DEVICES), $20.00 (for 3-5 DEVICES) $25.00 (for 6-10 DEVICES) and includes all postage (inbound and outbound) and labor associated with processing your items. More than 10 DEVICES will depend upon weight plus $20.00. Any other devices in that order will then be paid on. 
27. We will allow you TWO (2) days to make that decision. The 48 hours begin from the date and time the Post Inspection Offer was emailed to you.  No response within 48 hours of the Post Inspection Offer email being sent is accepted as "agreeing to the Post Inspection Offer" and the order will continue to be processed at the Post Inspection offer. 
28. If you decide you want them back, you have FIVE (5) days to place in the mail an envelope containing a US money order (no personal checks) to cover return postage and costs.  Return requests with US money order for return postage as outline above should be sent to:  Sell My Old Cell Phone, PO Box 731, Helotes, TX 78023.  Five days is determined by measuring from the date you decline (ONLY if it is within the 48 hour period mentioned previously) to the post mark on your envelope (it must be five days or less in order to get them back). If not mailed within 5 days, any phones or other electronic equipment on hold will be recycled and no longer available.
29. Finally, all Pre-Inspection tentative offers to buy cell phones or other electronic equipment, at the initially stated price are good for 10 days from the date the purchase invoice and e-label is produced. SellMyOldCellPhone reserves the absolute right to reject any order for any reason.  If we outright reject an order, for any reason not listed anywhere in these Terms and Conditions, we will pay the return shipping.
30.  Any U.S. Citizen residing within the United States and is at least 18 years old.  If a minor sells their cell phone or other electronic equipment, and the responsible party of that minor wishes to have it back, that responsible party will be required to pay for all return shipping and other charges associated with that device  to get it back (so long as they follow the guidelines of these Terms and Conditions), without exception. SellMyOldCellPhone.com will not accept liability for the behavior of minors.
31. You have sent in your phones or other electronic device with the obvious intention of garnering cash.   You have indicated that your device is in working order as described above and in 4 star condition in order to receive the maximum allotted in the invoice.  You also understand that if your device is not in 4 star condition, SellMyOldCellPhone will still buy it but at a reduced rate outlined above and you have the opportunity to accept or decline as outlined within these Terms and Conditions.  You also understand that we do not buy phones with red dots, even if they work fine, and will not be returned under any circumstance.  You also understand that some phones are eligible for return and others are not.  The ONLY device(s) eligible for a return are device(s) that are NOT broken, able to be reactivated, do not have red dots, and are reduced solely based on cosmetic condition.  All other devices are not eligible for return and will be disposed of properly.
32. These Terms and Conditions (Selling Agreement) provide the rules governing the sale and purchase of used cell phones and other electronic equipment and act as an agreement between the seller (you) and the buyer (SellMyOldCellPhone).
33. These Terms and Conditions (Selling Agreement) holds each party to certain responsibilities to ensure that a fair and equitable practice is engaged. Submission of the invoice to sell your phones constitutes full acceptance of these terms and conditions (Selling Agreement). This is indicated by the seller checking the box (Agreeing to the Terms and Conditions) prior to submitting their order.
34. SellMyOldCellPhone.com does not guarantee any payment based solely on the Pre-Inspection Invoice you created without first having the opportunity to receive and process the equipment to make sure they meet the Terms and Conditions (Selling Agreement) as outlined in this document.  The service we provide is an opportunity for you to have your cell phone(s) and other electronic equipment evaluated for the purpose of selling them to SellMyOldCellPhone.com. To whatever degree your equipment meets our evaluation, as outlined above, SellMyOldCellPhone.com will pay you that amount lest you disagree and provide return postage and applicable fees within the timeline stated above for devices eligible for return.
35. Please do not list a phone or any other piece of equipment if it is broken (as described above) or cannot be reactivated due to being stolen, having a balance, or any other factor prohibiting it from being reactivated, unless you have indicated so on the invoice form.  Any equipment sent that does not meet the above criteria of these Terms and Conditions and will become the property of SellMyOldCellPhone.com and disposed of as seen fit to recover losses associated with acquiring the equipment, labor spent on processing, and any administrative costs.
36. Just be honest in creating your invoice and we will be glad to provide what that piece of equipment is worth, based on current used market value.  Also note, no buy site will buy it at full value if it is broken or cannot be activated and SellMyOldCellPhone.com is no different.  With all this being said, SellMyOldCellPhone.com will do everything in its power to earn your business now and in the future.
